14. Minors

Determine whether the following minors should be prohibited from being hired and from performing their respective duties indicated hereunder: 5%

1. A 17-year old boy working as a miner at the Walwaldi Mining Corporation.

2. An 11-year old boy who is an accomplished singer and performer in different parts of the country.

3. A 15-year old girl working as a library assistant in a girls’ high school.

4. A 16-year old girl working as a model promoting alcoholic beverages.

5. A 17-year old boy working as a dealer in a casino.

XIV.

1.

A 17-year old boy is prohibited from working as a miner at the Walwaldi Mining Corporation. A minor cannot be employed in a hazardous work.

2.

An 11-year old boy can sing and perform in different parts of the country, provided the following requirements are met:

a. Employment contract, if any, is concluded by the child’s parents or legal guardian, with the expressed agreement of the child concerned, if possible, and the approval of the DOLE;

b. The employer or the child’s parents shall ensure the protection, health, safety and morals of the child;

c. The employer or the child’s parents shall institute measures to prevent the child’s exploitation or discrimination.

d. The employer or the child’s parents shall formulate and implement, subject to the approval and supervision of competent authorities, a continuing program for training and skills acquisition of the child.

e. The employer or the child’s parents shall first secure, a work permit from the DOLE which shall ensure observance of the above requirements.

A 15-year old girl is not prohibited from working as a library assistant in a girls’ high school, since this is not hazardous to her health.

4.

A 16-year old girl is not prohibited to work as a model promoting alcoholic beverages, since working as a model is not hazardous to her health. Her welfare including her morals should, however, should be protected.

5.

A 17-year old boy is prohibited from working as a dealer in a casino. This is hazardous to his health as he would be working at nighttime.
