A no-union can win in certification election. This means that the employees do not want to be unionized.
2.
Run-off election occurs when a certification election which provides for 3 or more choices results in no choice receiving a majority of the valid votes cast, provided, the total number of votes for all contending unions is at least 50% of the number of votes cast. In such case, an election is conducted between the labor unions receiving the 2 highest number of votes.
